Terms of Use

1. Acceptance of Terms

By downloading, installing, or using FieldIQ ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms apply to all users of the App.

FieldIQ is operated by Heath Chartier, doing business as FieldIQ ("we," "us," or "our"), based in California, United States.

2. Description of Service

FieldIQ is a mobile application for outside sales representatives that provides route planning, customer visit tracking, territory management, and related field sales tools. The App is available on iOS via the Apple App Store.

Certain features require an active FieldIQ Pro subscription. Features may change over time. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. Auto-Renewable Subscription

FieldIQ Pro is an auto-renewable subscription offered through the Apple App Store (In-App Purchase). By subscribing, you acknowledge and agree to the following:

• Subscription Name: FieldIQ Pro
• Subscription Length: 1 month
• Price: $19.99 per month (USD). Prices may vary by region and are displayed in the App Store prior to purchase.
• Free Trial: A 14-day free trial is available for new subscribers. You will not be charged during the trial period. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid monthly subscription at the then-current price.
• Billing: Payment is charged to your Apple ID account at confirmation of purchase. Subscription auto-renews monthly at the same price unless cancelled.
• Cancellation: You may cancel at any time via Apple ID Account Settings → Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused portions of a period.
• Renewal Notice: Your subscription renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Price Changes: We will notify you of price changes in advance. Continued use after a price change constitutes acceptance.

All subscription billing is processed by Apple. FieldIQ does not store or process payment card information.

4. Refund Policy

All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies. To request a refund, contact Apple directly at reportaproblem.apple.com. We do not issue refunds directly.

5. User Accounts

FieldIQ supports sign-in via Apple ID (Sign in with Apple) and email/password authentication. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You may delete your account at any time from within the App (Settings → Account → Delete My Account). Account deletion is permanent and removes all associated data.

6. User Data and Content

You retain ownership of all customer data, notes, and content you enter into FieldIQ. By using the App, you grant us a limited license to store and process your data solely to provide the service to you.

We do not sell your data to third parties. See our Privacy Policy for full details on how we collect, use, and protect your information.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable law
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Share account access with others or resell access to the App
• Use the App to transmit spam, malware, or harmful content
• Interfere with or disrupt the App's infrastructure or servers
• Upload data you do not have the right to store or process

8. Intellectual Property

FieldIQ and all associated content, design, trademarks, and software are the property of Heath Chartier / FieldIQ. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal business purposes only. You may not copy, reproduce, or distribute any part of the App without prior written permission.

9. Disclaimers and Limitation of Liability

FieldIQ is provided "as is" without warranty of any kind, express or implied. We do not warrant that the App will be error-free or uninterrupted.

To the maximum extent permitted by applicable law, FieldIQ and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid in the twelve (12) months preceding the claim.

10. Third-Party Services

FieldIQ integrates with third-party services including Apple (Sign in with Apple, App Store), Supabase (data storage), and mapping services. Use of these services is subject to their respective terms and privacy policies.

11. Apple App Store — End User License Agreement

Your use of FieldIQ is also governed by Apple's Standard End User License Agreement (EULA). Apple is a third-party beneficiary to these Terms and may enforce them against you.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the App or by email. Continued use of the App after changes take effect constitutes your acceptance. The "Last updated" date at the top reflects the most recent revision.

13. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.
